How report custody works
Start with the agency that investigated.
Location helps narrow the search, but the responding agency determines where the report is kept.

San Jose roads point to a likely agency—not a guaranteed one.
CHP’s San Jose Area says it patrols I-280, US-101, I-880, SR-87, plus I-680, SR-17, SR-85, SR-130, and SR-237. For a crash on one of these routes, start with CHP only when you do not know who investigated, then confirm the agency on scene paperwork.
For a San Jose city street, SJPD is the likely starting point. In unincorporated Santa Clara County, do not assume the Sheriff holds the report: CHP may be the traffic-report custodian unless a sheriff’s deputy actually investigated.
Usually the starting point when CHP investigated a freeway, state-highway, or unincorporated-area collision.
CHP policy says routine crash investigations should normally be public within 8 business days, complex investigations within 15, and fatal-injury investigations within 30. These are normal targets, not guarantees; call before traveling.
The starting point only when the Santa Clara County Sheriff’s Office actually investigated the collision.
The Sheriff’s Office says a completed accident report may be released to an involved party on the same day it is requested. This does not promise that an investigation is already complete.
A freeway or city-street answer is only a clue. The finder gives priority to an agency you identify, keeps uncertain unincorporated-area crashes as a confirmation case, and never silently sends an unknown agency to a listed department.
Before paying
Start on a government page and confirm any report-vendor link originated there.
If nothing appears
Check agency, completion timing, incident details, and restricted request channels before concluding that no report exists.
